Booking Terms & Conditions

The purpose of this document is to regulate the Terms & Conditions of booking services of Casa Netwon, owned by Fabbrica Pienza Soc. Agr. Semplice, with registered offices in Loc. Borghetto, snc, Pienza (SI), VAT and Italian tax code no. 01347950527 (hereinafter also referred to as “Us”, “Our”, “We” or “Casa Newton”).

The terms “You” or “Guest” are used here to refer to all individuals and/or entities who for whatever reason use the services of Casa Newton.

Please read these Terms & Conditions carefully before booking with Casa Newton as they set out Our respective rights and obligations, including the cancellation policy set forth below.

  1. Acceptance of the Terms & Conditions
    a) By making a booking, the Guest hereby represents and accepts the following: a) that the Guest has the authority to bind to the contract all persons named on the booking, including legal entities;
    b) confirms that the details provided for all parties to the booking are full and accurate;
    c) confirms that the Guest has read and understood these Terms & Conditions and agrees (for the Guest and on behalf of each person named on the booking) to be bound by them;
    d)confirms that the Guest has read Our Privacy Policy, which is available on Our website and confirms that the Guest will provide Our Privacy Policy to each named person on the booking; and
    e) confirms that the Guest is 18 years of age or over and, where placing an order for services with age restrictions, declares that the Guest and all members of the party are of the appropriate age to purchase such services.
  2. Bookings made via other platforms
    Bookings made via any other platform will be subject to the booking process and cancellation policy applied by the platform provider. Any changes to the reservation will need to be made via the original booking platform.
  3. Bookings made directly with Casa Newton
    3.1. Any pre-booking services are for information only, and their sole purpose is to offer the Guest possibility of checking the availability of a room. Please note that, before the booking confirmation, the Guest may be made aware of the existence of restrictions in relation to some services which may not be available during their stay or regarding the restricted use of some areas of Casa Newton.
    3.2. Additional charges may apply to the room rate, including, but not limited to meals, drinks, room service, use of wireless internet access, leisure, fitness or entertainment facilities or activities, use of any function or other rooms, or any other equipment, services or facilities. We will inform you of the cost of such additional services on request when you arrive at Casa Newton.
    3.3. At the time of Booking, the Guest will be required to provide credit card details.
    The Guest will receive an email within 24 hrs confirming if their booking has been processed.The booking will become binding once Casa Newton has accepted the reservation by means of email confirmation and, if required, subsequent payment by the Guest.
    The Guest must verify the booking confirmation and notify Casa Newton of any error immediately in writing.
    3.4. The booking is confirmed and guaranteed with a credit card.
    The name on the credit card provided for the booking must correspond to that of the Guest staying with Us, unless otherwise expressly agreed with Casa Newton.
    The credit card used to book will be requested upon arrival to verify that the details given are correct. The credit card holder must be present at this time.
    3.5. If pre-payment is not required, payment is due upon check-out and can be made by credit card, debit card, cash (subject to local laws) or by Casa Newton gift vouchers. Upon check-in, all bookings will require pre-authorisation with a credit card to cover incidentals during Your stay amounting to 10 % of the booking.
  4. Prices
    4.1. Prices relating to the booking will be indicated during the booking process and will provide details of what is included in such price.
    4.2. Prices are valid only in writing, for the period specified and include V.A.T.
    4.3. V.A.T. is applicable on these prices without prejudice to local taxes also being applied in accordance with existing Italian law, which must be paid directly at Casa Newton.
  5. Guarantees
    5.1. Casa Newton reserves the right to check the validity of the card prior to the Guest’s arrival by making a pre-authorization or charging a certain amount, which will never exceed the equivalent of the first night of the reservation.
    A pre-authorization temporarily retains or “freezes” a specific amount on the Guest’s bank account in order to check the validity of the card and/or the existence of funds.
    5.2. If the transaction cannot be processed, it shall be deemed as the credit card is not valid. In this case, it may result in the automatic cancellation of the booking.
    5.3. The release or refund period depends exclusively on the card issuer, therefore Casa Newton has no responsibility for any delays.
  6. Cancellation policy
    6.1. Cancellation policy: bookings made directly with Casa Newton
    The following cancellation policy applies to Guests who booked directly with Casa Newton:
    - 100% refundable, if the booking is cancelled up to 30 days before Your stay;
    - 80% refundable, if the booking is cancelled up to 14 days before Your stay;
    - 50% refundable, if the booking is cancelled up to 24h before Your stay;
    - non-refundable, if the booking is cancelled within 24h before Your stay;
    - in the event of a no-show without prior notice, the first night will be charged (including VAT and taxes).
    6.2. For stays longer than 10 days:
    - 100% refundable, if the booking is cancelled up to 60 days before Your stay, following which You will automatically be charged 25% of Your booking;
    - 75% refundable, if the booking is cancelled up to 14 days before Your stay.
    6.3. Bookings made less than 7 days before arrival:
    - 100% refundable, if the booking is cancelled within 24h after the booking is made, following which 75% of Your booking will NOT be refunded;
    - if the booking is cancelled 24h before Your stay, 100% of the booking will be non-refundable and the entire amount of the stay will be due.
    6.4. Any night cancelled during Your stay will be paid in full.
  7. Changes made to the Booking by the Guest
    7.1. If the Guest or anyone named on the booking wishes to change any part of a confirmed booking, they can only do so by contacting Casa Newton and paying the applicable cancellation/amendment fee.
    7.2. Based on availability, We may be able to change the dates of Your stay to accommodate Your request. In such case, the price of the rooms will updated based on the rates that apply to the new dates.
    Once the dates have been changed, the booking will become non-refundable.
    7.3. Bookings made directly with Casa Newton are not transferable without Our written consent. We will apply any monies You have already paid to Us towards settling any cancellation charge(s) (and to the extent Your payments exceed the sum due, We will refund the balance).
  8. Changes/Cancellations made to the Booking by Casa Newton
    From time to time, We may need to make a change, or very occasionally cancel, Your booking. We reserve the right to do so at any time.
    Most changes will be of a minor nature, which are not likely to cause any prejudice to the Guest. We will, however, always notify You prior to Your arrival.
    However, occasionally We have to notify Guests of a major change to the main characteristics of the booking that We are constrained to make.
    In the unlikely event that We have to make a major change or cancel Your booking, We will tell You as soon as reasonably possible. In such circumstances You will be offered a full refund, but We shall have no further liability to You arising out of such cancellation or major change.
  9. Check-In and Check-Out
    9.1. The earliest check-in time is 3:00 p.m., unless a different time has been agreed between You and Casa Newton.
    9.2. Guests will be asked to provide proof of identify upon check-in. Acceptable forms of identification are a passport or driving licence.
    9.3. The latest time by which You must vacate Your room and check-out is 11:00 a.m., unless a different time has been agreed between You and Casa Newton.
    9.4. Casa Newton may beforehand agree at Our discretion to an arrangement for a later check-out time, but if We have not agreed to a later time and You do not vacate Your room and check out by the above latest time, We will be entitled to charge You for an additional night’s accommodation at the standard applicable rate.
    9.5. If Casa Newton have agreed and arranged a late check-out under the provision above, We shall be entitled to charge You at an hourly rate for the additional time from Our standard latest checkout time until the time You check-out, and We shall give You details of the hourly rate of that charge when You request a late check-out.
  10. Occupancy
    10.1. The maximum room occupancy is 2 adults, except special request approved by Casa Newton. You must not exceed the maximum occupancy for the room allocated to You. We reserve the right to conduct checks on occupancy. Occupancy is not transferable.
    10.2. We reserve the right to change Your room allocation at any point during Your stay for any reason.
  11. Car parking
    11.1. We cannot guarantee that any car parking space(s) will be available for You, but you may use any vacant space in Our Guest car park on a first-come-first-served basis provided that you have given Us Your vehicle plate number when you arrive. Any such parking will be without charge.
    11.2. Whilst We will operate and maintain Our Guest car park with reasonable skill and care, We do not guarantee that other Guests or members of the public will not enter Our Guest car park and steal or damage your vehicle or property in it. When You park or arrange for parking of your vehicle in Our car park, you accept the risk of theft or damage of or to Your vehicle and property in it if it is caused by any person other than Our staff.
    11.3. The road leading to Casa Newton is not paved. Guests accept any damage that may be caused to their vehicle on such road.
  12. Casa Newton Rules
    12.1. You must conduct Yourself in a reasonable and responsible manner at all times when on Casa Newton property and must not act in any way which may disturb other guests. If You do not, We may ask You to leave Casa Newton and, in that case, You must immediately pay Us all sums due.
    12.2. We have a strict policy against the use of Casa Newton for the commission of criminal offences (including but not limited to the taking of drugs, prostitution). We reserve the right to eject/refuse entry to any person and to alert the relevant authorities, if We have reasonable suspicion that Casa Newton may be used for such a purpose.
    12.3. Smoking is not permitted in any of Our rooms or common areas, excluding for designated outdoor areas, such as the outside bar tables, around the pool and outside the Cervo restaurant. This includes the smoking of e-cigarettes. Failure to comply will cause Us to charge You for any and all costs We incur in cleaning the room (including, but not limited to, fixtures, fittings and soft furnishings) and restoring it to a smoke-free environment.
    12.4. In Casa Newton it is prohibited to:
    - bring any animals or pets into Casa Newton, with the exception of assistance or guide dogs as agreed in advance with Us and which will stay in one of Our pet-friendly rooms;
    - bring any potentially dangerous or hazardous materials or equipment onto Our premises or rooms;
    - use any electrical appliances that may set off fire alarm system, such as toasters, mini cookers or portable grills;
    - tamper with any fire alarms or emergency equipment;
    - utilise any of Our rooms to store items (personal or otherwise) which could in Our sole opinion cause damage to Our premises or rooms, or be a risk to the health and safety of Our staff, guests or property;
    - prevent Our management, housekeeping and/or maintenance staff from having access to Your room as and when required, with housekeeping being permitted full access at least once every two days;
    - remove, damage or destroy any of Our property;
    - use any technology that may be provided by Us to download or access any unlawful or obscene material;
    - cause unreasonable disturbance to any other guests or staff. We will charge You for any and all damage caused by You during Your stay.
    12.5. Guests are also required to the aware of and comply with the following:
    - Casa Newton is an old villa and certain aspects may not be up to modern standards;
    - inside Casa Newton there are numerous works of art of considerable value;
    - the bar serve alcohol only for Guests over 18 years of age. You are responsible for Your own consumption. We retain the right refuse to serve alcohol to any Guests who We deem have had too much to drink;
    - Our swimming pool has strict rules that can be found on the premises, and which You hereby agree to accept.
    12.6. All of the rules set forth above will also apply to members of Your party and Your guests and You shall be liable for any breach of the above rules by any of them. If You or Your group cause damage or loss of any kind to Our Property, other guests or their property, You as the Guest who is making the booking will be responsible for that damage or loss and You shall be liable to pay to Us on demand the amount required to make good or remedy such damage or loss.
    12.7. If You or Your group caused damage to Casa Newton property, other Guests or their property, or otherwise breach any of these Terms & Conditions, We reserve the right to:
    - cancel Your reservation with immediate effect and (if appropriate) require You to leave Our premises;
    - restrict access to Our premises;
    - remove Your items from the room and Our premises, disposing of such items in the event that You do not collect them within 7 days of removal;
    - retain all sums paid by You and/or charge You the full amount of Your reservation; or
    - refuse future reservations from You and/or refuse You entry or accommodation at Our premises.
      In such cases, We will not be liable to refund or compensate You.
    12.8. Full payment for any such damage or losses must be paid directly to Us or the applicable supplier prior to Your ejection from Casa Newton. In the event that Your behaviour (or any articles carried by You) causes loss or damage to any person or property for which We are liable, You agree to compensate Us for such loss and damage, together with any legal costs which We may incur in pursuing this claim against You. We cannot be held responsible for the actions or behaviour of other Guests or individuals who have no connection with Your Booking with us.
    12.9. We reserve the right to decline or cancel reservations made and stays in progress by those who have previously breached these Terms & Conditions (as may be updated from time to time) whether the reservation is in that name or not.
  13. CCTV
    13.1. Closed Circuit Television Systems (CCTV) are installed in the communal areas of Casa Newton.
    13.2. The purpose of the CCTV system is to:
         - improve the safety and security of Guests, visitors, employees and any third party who accesses Our premises;
         - provide assistance to local law enforcement authorities, if required;
    13.3. Access to the CCTV system and stored images is restricted to authorised Casa Newton personnel only for the purposes set out above.
    13.4. In appropriate circumstances, CCTV footage may be accessed by:
         - local law enforcement authorities when Casa Newton is required by law to assist during investigations;
         - data subjects (or their legal representatives), pursuant to an access request as provided in our Privacy Policy;
         - by individuals (or their legal representatives) subject to a court order.
  14. Food and drink
    Unless We have specifically stated or do state otherwise, food and drinks are not included in any rate(s) for bedroom accommodation and We will apply additional charges to You in accordance with clause 4 above.
    If You or any of Your party or guests have any special dietary requirements, You should inform Us of them in advance of Your arrival. We will use all reasonable endeavors to accommodate those requirements and, where this is not possible, tell You that We are unable to do so. We will inform You of mealtimes at the time of Your arrival.
  15. Policy on minors
    Minors under the age of 18 staying at Casa Newton must be accompanied by their parents, teachers or other duly authorized adults. Our staff may require relevant documentation identifying adults as parents/teachers of authorized persons. Different underage limits may be established and determined by Italian law. We are not responsible for any children and young adults. The responsibility lies on the Guest accompanying the minor.
  16. Disabilities, Reduced Mobility and Medical Conditions
    Casa Newton complies with the access requirements of local disability legislation. If You or any member of Your party has any medical condition, reduced mobility or disability which may affect Your trip, please provide Us with full details before We confirm Your Booking so that We can try to advise You as to the suitability of Your chosen arrangements. Acting reasonably, if We are unable to appropriately accommodate the needs of the person(s) concerned, We will not confirm Your Booking or if You did not give Us full details at the time of booking, We will cancel it and impose applicable cancellation charges when We become aware of these details.
  17. Limitation of liability
    17.1. To the fullest extent permissible by law, We do not accept any liability for any damage, loss or expense or other sum(s).
    17.2. We deny any liability related to:
        a) Your misrepresentation or lack of information (by way of non-exhaustive examples, if You fail to notify Us of a food allergy or medical condition);
        b) item(s) not expressly deposited for safe custody in the safety deposit boxes located in the rooms;
    17.3. You shall notify any claim to Us strictly in accordance with the complaint procedure set out in clause 22 of these Terms & Conditions
    17.4. Where any payment is made as compensation for damage, the person(s) receiving it (and their parent or legal guardian if under 18 years) must also assign to Us or Our insurers any rights they may have to pursue any third party and must provide Us and Our insurers with all assistance We may reasonably require.
  18. Consumers
    The next two clauses are only applicable if You are a Consumer. A “Consumer” is an individual customer or Guest who receives
    18.1. We provide all Services only for Your personal and private use/purposes. We make no warranty or representation that products, or other goods or materials that We provide, or sell are fit for commercial, business, industrial, trade, craft or professional purposes of any kind (including resale). We will not be liable to You for any loss of profit, loss of contract, loss of commercial opportunity or any indirect or consequential loss or damage.
    18.2. Nothing in these Conditions is intended to or will exclude, limit, prejudice or otherwise affect any of Our duties or obligations to You, or Your rights or remedies, or Our liability to You, under the regulations or any other consumer protection legislation as amended from time to time.
  19. Changes to these conditions
    We may from time to time change these Conditions without providing You with notice.
  20. Disclaimer
    20.1. All bookings are subject to availability at the time You make Your booking. We try hard to make sure that Our advertisements are kept up to date, but We do not guarantee that any of the services We advertise will still be available at the time of Booking. We will inform You as soon as possible after placing a Booking if, for any reason, the services You have sought to book with Us are not available.
    20.2. We may change the advertised price of any service from time to time. We try hard to make sure that the advertised price is the most up-to-date price, but prices can change at short notice. We will confirm the actual price at the time of booking.
    20.3. We advertise a large number of arrangements, and We try hard to ensure that the advertised price is always accurate, but sometimes errors do occur. We will normally verify prices at the time of Booking. If there is mistake, and the actual price is lower than that given at the time of booking, We will only charge You the lower amount. If the price is higher, We will contact You for instructions or reject Your Booking (at Our sole discretion) and notify You of this so that You can decide what You would like to do. You must check the current price and all other details relating to the services that You wish to book before Your Booking is confirmed.
    20.4. We are not responsible for refunding or meeting any expenses or losses You may incur as a result of changes or cancellations made to a locally booked excursion, whether these changes or cancellations are made by You or the provider of the locally booked excursion.
  21. How We use your personal information
    All personal information provided by You will be collected, processed and used in line with the Our Privacy Policy, which explains what personal information We may collect from You, how and why We collect, store and use and share such information, Your rights in relation to such personal information and how You can contact Us and any Supervisory Authority if You have a query or complaint about the way in which We use any personal information.   22. Complaints
    We always welcome feedback from Guests and, whilst We always use all reasonable endeavours to ensure that Your experience as a Guest of ours is a positive one, We nevertheless want to hear from You if You have any cause for complaint. If You have any complaint about Our services or any other complaint about Casa Newton or any of Our staff, please raise the matter with the General Manager who can be contacted by phone at +39 0578 810043 or via e-mail at within 7 days from the occurrence that you wish to report to Us.
  23. Force majeure
    We shall not be in breach of these Terms & Conditions, nor shall We be liable for any delay in performing, or failure to perform, any of Our obligations under these Conditions if such failure or delay results from an event, circumstance or causes beyond Our reasonable control. Such causes include, but are not limited to, power failure, internet service provider failure, fire, flood, storms, earthquakes, pandemics, acts of terror or any other event that is beyond Our control.
  24. No waiver
    If We do not insist that You perform any of Your obligations under these Terms & Conditions, or if We do not enforce Our rights against You, or if We delay in doing so, that will not mean that We have waived Our rights against You or that You do not have to comply with those obligations. If We do waive any rights, We will only do so in writing, and that will not mean that We will automatically waive any right related to any later default by You.
  25. Severance
    Each clause of these Terms & Conditions operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining clauses will remain in full force and effect.
  26. Governing law and jurisdiction
    These Terms & Conditions, any contract between Us and the relationship between You and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with, the laws of Italy. Any dispute or claim arising out of these Terms & Conditions, any contract between Us and relationship between Us shall be settled exclusively by the Courts of Florence.
